1. Introduction

Welcome to JomGig. These Terms of Service ("Terms") govern your access to and use of the JomGig platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.

2. Acceptance of Terms

By creating an account, accessing, or using JomGig, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old to use our Services.

3. Platform Description

JomGig is a digital marketplace that connects customers seeking services with independent gig workers offering those services. We provide the platform for these connections but are not a party to the actual service agreements between customers and workers.

JomGig facilitates transactions, provides payment processing, and offers support, but the actual service relationship exists between the customer and the worker.

4. User Responsibilities

Provide accurate and complete information during registration
Maintain the security and confidentiality of your account credentials
Use the platform in compliance with all applicable laws and regulations
Not engage in fraudulent, abusive, or illegal activities
Not impersonate others or provide false information
Respect intellectual property rights and not violate any third-party rights

5. Identity Verification

To maintain platform safety and trust, workers must complete identity verification before offering services. This includes submitting valid government-issued identification documents.

JomGig reserves the right to verify user identities and may suspend or terminate accounts that fail to complete verification or provide fraudulent information.

6. IMPORTANT: Platform Protection and Off-Platform Transactions

TRANSACTION PROTECTION DISCLAIMER

JomGig provides transaction protection and dispute resolution ONLY for services booked and paid for through our official platform.

⚠️ WE WILL NOT BE HELD ACCOUNTABLE IF:

You engage in transactions outside of the JomGig platform (off-platform transactions)
You hire or pay workers directly without using our booking and payment system
You work with unverified gigworkers who have not completed our ID verification process
You share personal contact information to arrange services outside our platform
You make payments through external methods (cash, bank transfer, e-wallets) instead of our secure payment system

By bypassing our platform's official booking and payment processes, you forfeit all protections, including but not limited to: payment protection, dispute resolution, insurance coverage, customer support, and legal recourse through JomGig.

✓ STAY PROTECTED:

Always book services through the JomGig platform
Use only our secure in-platform payment system
Verify that workers have completed ID verification (look for the verified badge)
Keep all communications within the JomGig messaging system
Report any suspicious activity or workers requesting off-platform payments

Your safety is our priority when you use our platform as intended. We cannot protect you from transactions that occur outside our ecosystem.

7. Payment Terms

All payments for services must be processed through the JomGig platform. We use secure payment processing and may charge service fees for facilitating transactions.

Service fees are clearly disclosed before booking confirmation
Payments are held in Beaver Tokens until service completion
Refunds are subject to our refund policy and dispute resolution process
Workers receive payment after service completion and customer confirmation

8. Cancellation and Refunds

Both customers and workers have the right to cancel bookings subject to our cancellation policy. Cancellation fees may apply depending on timing and circumstances.

Refund eligibility is determined on a case-by-case basis through our support team and dispute resolution process.

9. Dispute Resolution

In the event of a dispute between customers and workers, JomGig will make reasonable efforts to mediate and resolve the issue fairly.

Users agree to first attempt resolution through our platform's dispute resolution process before pursuing external legal action.

10. Limitation of Liability

JomGig provides the platform "as is" and makes no warranties regarding the quality, reliability, or suitability of services provided by workers.

To the maximum extent permitted by law, JomGig shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services.

11. Account Termination

JomGig reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or for any other reason we deem necessary to protect our platform and users.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notifications. Continued use of the Services after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14. Anti-Money Laundering and Counter-Terrorism Financing

AMLA Compliance and Prohibited Activities

JomGig is committed to full compliance with Malaysia's Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) and all related regulations. We maintain a zero-tolerance policy towards money laundering, terrorism financing, and any form of financial crime.

🚫 STRICTLY PROHIBITED ACTIVITIES:

Using the platform for money laundering or any suspicious financial transactions
Financing or supporting terrorism or terrorist organizations
Processing proceeds from unlawful activities or criminal offenses
Conducting transactions designed to avoid reporting or monitoring requirements
Creating accounts or conducting activities using false or stolen identities
Engaging in structured transactions to evade detection or reporting thresholds
Using the platform to facilitate or conceal illegal activities of any nature

⚖️ CONSEQUENCES AND ENFORCEMENT:

Immediate account suspension or termination without prior notice
Freezing of funds and withholding of payments pending investigation
Mandatory reporting to relevant authorities including Bank Negara Malaysia and law enforcement
Full cooperation with regulatory and criminal investigations
Permanent ban from the platform with no eligibility for reinstatement
Legal action and prosecution under applicable Malaysian laws

JomGig reserves the right to conduct enhanced due diligence, request additional identification or verification documents, monitor transactions for suspicious patterns, and report any suspicious activities to the relevant authorities as required by law. Users must cooperate fully with any such requests.

By using JomGig, you acknowledge that you will not engage in any activities that violate AMLA or related financial crime prevention laws, and you consent to our monitoring and reporting obligations under Malaysian law.

15. Beaver Token - Platform Currency Limitations

Important Limitations on Beaver Token Usage

Beaver Token is JomGig's proprietary platform currency designed exclusively for use within the JomGig ecosystem. It is NOT a cryptocurrency, security, investment instrument, or legal tender.

WHY WE USE BEAVER TOKEN INSTEAD OF DIRECT CASH TRANSACTIONS:

JomGig uses Beaver Token as an intermediary platform currency instead of direct cash/real money transactions for critical security and anti-fraud purposes:

Scam Prevention: Using platform tokens prevents direct access to customer bank accounts and credit cards, reducing financial fraud risks
Transaction Control: All transactions are monitored and can be reversed or frozen if suspicious activity is detected, protecting both customers and workers
Chargeback Protection: Token-based transactions eliminate chargeback fraud that commonly affects direct payment systems
Identity Verification Buffer: Requires users to go through our verification and top-up process, creating an additional security layer against anonymous scammers
Payment Dispute Resolution: Tokens held in Beaver Tokens during service delivery allow fair dispute resolution without immediate cash transfers
Fraud Pattern Detection: Centralized token system enables better monitoring and detection of fraudulent behavior patterns
Account Security: If an account is compromised, tokens can be frozen immediately, whereas stolen cash cannot be recovered
Platform Accountability: Token trail provides complete transaction history for investigations and customer protection
Controlled Withdrawals: Workers can only withdraw earned tokens through verified banking details, preventing money laundering and fraud

🛡️ This token-based system creates a protective barrier between your real money and potential scammers, ensuring every transaction is traceable, reversible if fraudulent, and subject to platform security measures that direct cash transactions cannot provide.

📍 BEAVER TOKEN RESTRICTIONS:

Beaver Tokens can ONLY be used within the JomGig platform for booking services, subscriptions, and platform features
Beaver Tokens have NO monetary value outside of the JomGig platform
Beaver Tokens CANNOT be traded, sold, or exchanged on any external platform or marketplace
Beaver Tokens CANNOT be transferred to other users except through official platform features
Beaver Tokens are NOT redeemable for cash, fiat currency, or any real-world monetary equivalent
Beaver Tokens do NOT represent any ownership, equity, or stake in JomGig or its operations
Beaver Tokens are NOT an investment and carry no expectation of profit or financial return

✓ PEBTITTED USES:

Booking and paying for services from verified gig workers on JomGig
Purchasing subscription plans (Premium, Elite) within the platform
Accessing premium features and services offered by JomGig
Participating in official JomGig promotions, rewards, or incentive programs
Tipping workers through the platform's official tipping feature (if available)

🚫 PROHIBITED ACTIVITIES:

Trading, selling, or attempting to exchange Beaver Tokens outside the platform
Creating secondary markets or unofficial exchanges for Beaver Tokens
Using Beaver Tokens for money laundering, fraud, or any illegal activities
Exploiting platform vulnerabilities to generate unauthorized Beaver Tokens
Representing Beaver Tokens as having value beyond the JomGig platform
Using Beaver Tokens for speculative trading or investment purposes

JomGig reserves the right to modify Beaver Token terms, adjust exchange rates, limit token issuance, or discontinue the token system at any time with reasonable notice. Unused Beaver Tokens may expire according to our token expiration policy (if applicable).

Violation of these Beaver Token usage restrictions may result in immediate account suspension, forfeiture of token balances, and potential legal action.

Beaver Tokens are a proprietary digital currency for platform use only. They have no intrinsic value, are not backed by any physical assets, and do not constitute securities or financial instruments under Malaysian law.
